Terms of Service

Welcome to TrAIde ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the TrAIde website at https://traide.cloud, our iOS mobile application, and all associated services, features, and content (collectively, the "Services").

By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Services. You must be at least 18 years of age to use the Services.

TrAIde provides AI-powered quantitative analysis tools for cryptocurrency, stock/equity, and foreign exchange markets, including the proprietary TrAIde Score and associated analytical tools. All analysis is generated algorithmically and is intended solely for educational and informational purposes.

TrAIde is not a regulated financial service, broker, investment adviser, or financial institution. We are not registered with the Financial Conduct Authority (FCA), the Securities and Exchange Commission (SEC), the Commodity Futures Trading Commission (CFTC), or any other financial regulatory authority anywhere in the world.

BY USING THE SERVICES, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

4.1 You use the Services entirely at your own risk.

4.2 You are solely responsible for all data you input into the Services, including portfolio data, asset selections, and any other information you provide.

4.3 TrAIde has no visibility into, control over, or responsibility for how you interpret or act upon the analytical outputs generated by the Services.

4.4 TrAIde is not responsible for any financial loss, missed opportunity, tax liability, or any other consequence arising directly or indirectly from your use of the Services or reliance on any output generated by the Services.

4.5 Market data provided through the Services may be delayed, inaccurate, or incomplete. You should independently verify all data before making any financial decision.

4.6 AI-generated analysis and outputs may contain errors, omissions, or inaccuracies. Algorithmic outputs are not infallible and should always be used as one input among many in a broader research and decision-making process.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Services will be uninterrupted, error-free, or secure
• Warranties as to the accuracy, reliability, completeness, or timeliness of any data, analysis, score, or other output
• Warranties that any defects will be corrected

USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK. TRAIDE EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY INACCURACY IN MARKET DATA, ALGORITHMIC OUTPUTS, OR AI-GENERATED ANALYSIS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRAIDE AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or financial losses of any kind
• Any losses arising from trading or investment decisions made in reliance on the Services
• Any loss or damage caused by third-party services, data providers, or market conditions
• Any unauthorised access to or use of our servers or any personal information stored therein

IN NO EVENT SHALL TRAIDE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES EXCEED £100 (ONE HUNDRED POUNDS STERLING) OR THE EQUIVALENT IN YOUR LOCAL CURRENCY.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TrAIde is operated from the United Kingdom and is made available globally on an informational basis. However, the availability of the Services in a particular country or region does not constitute an endorsement, recommendation, or confirmation that use of the Services is lawful in that jurisdiction.

Laws and regulations governing cryptocurrency, financial analysis tools, and related services vary significantly by country and are subject to change. In particular, users in the following jurisdictions should be aware that local laws may significantly restrict or prohibit the use of cryptocurrency-related services:

• United States of America (and its territories): Cryptocurrency and financial analysis tools may be subject to regulation by the SEC, CFTC, FinCEN, and other federal or state agencies. US persons should seek independent legal advice before using the Services.
• People's Republic of China: Cryptocurrency-related activities are broadly restricted under Chinese law.
• North Korea, Iran, Syria, Cuba, and Russia: Use of the Services may be prohibited under applicable international sanctions and local law.
• Any jurisdiction where use of such services is restricted, licensed, or prohibited by applicable law.

This list is not exhaustive. It is your sole responsibility to determine whether your use of the Services is permitted under the laws and regulations of your country, region, or jurisdiction. TrAIde makes no representation that the Services are appropriate, legal, or available for use in any specific location.

By accessing the Services, you confirm that you have satisfied yourself that doing so is lawful in your jurisdiction, and you agree to comply with all applicable local laws and regulations. TrAIde accepts no liability whatsoever for your use of the Services in any jurisdiction where such use may be restricted, regulated, or prohibited.

8.1 Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8.2 You are solely responsible for any data you choose to input into the Services. TrAIde does not have visibility into your portfolio data, analysis queries, or trading decisions.

8.3 TrAIde does not sell, rent, or trade your personal information to third parties. We do not use your data to train AI models.

8.4 By using the Services, you consent to the collection and use of information as described in our Privacy Policy.

9.1 You are responsible for maintaining the confidentiality and security of your account credentials at all times.

9.2 You must not share your account login details with any other person. Each account is for the sole use of the individual who registered it. Sharing accounts is strictly prohibited and may result in immediate account termination.

9.3 You are responsible for all activity that occurs under your account, whether or not authorised by you. If you suspect unauthorised access to your account, you must notify us immediately at support@traide.cloud.

9.4 TrAIde is not liable for any loss or damage arising from your failure to maintain account security or from unauthorised use of your account.

All content, software, design, algorithms, branding, and methodology — including the TrAIde Score, its underlying Alpha-Beta Kalman filter methodology, and all associated tools — are the exclusive intellectual property of TrAIde. All rights are reserved.

You may not reproduce, redistribute, resell, reverse-engineer, scrape, or create derivative works from any part of the Services without prior written permission from TrAIde.

The TrAIde name, logo, and "TrAIde Score" are proprietary marks of the Company.

You agree to use the Services only for lawful purposes. You agree not to:

• Use the Services for any unlawful, fraudulent, or harmful purpose
• Attempt to reverse-engineer, decompile, or extract the source code of the Services
• Use automated tools, bots, or scripts to scrape or access the Services
• Impersonate any person or entity
• Introduce malware, viruses, or any harmful code
• Use the Services to provide financial advice or recommendations to third parties without appropriate regulatory authorisation
• Share your account credentials with any other person
• Circumvent any security or access controls

We reserve the right to suspend or terminate any account that violates these Terms, without notice.

The Services integrate data from third-party providers including CoinGecko, TradingView, Yahoo Finance, Alpha Vantage, CoinMarketCap, and others. TrAIde does not control these third-party services and is not responsible for the accuracy, completeness, timeliness, or availability of third-party data.

Your use of any third-party services accessed through or linked from the Services is governed by their respective terms and privacy policies. TrAIde accepts no liability for third-party service failures, data errors, or interruptions.

We use only essential session cookies strictly necessary to operate the Services, such as maintaining your login session. We do not use tracking cookies, advertising cookies, or analytics cookies. No cookie consent banner is displayed because no tracking or non-essential cookies are set.

TrAIde shall not be liable for any failure or delay in the performance of the Services arising out of or caused by circumstances beyond our reasonable control, including but not limited to:

• Acts of God, natural disasters, or extreme weather events
• War, terrorism, civil unrest, or government action
• Failures of third-party infrastructure, APIs, or data providers (including CoinGecko, TradingView, or other market data services)
• Internet or telecommunications outages
• Cyber attacks, hacking, or distributed denial-of-service (DDoS) attacks
• Changes in applicable law or regulation that prevent or restrict operation of the Services

In such circumstances, our obligations under these Terms will be suspended for the duration of the event. We will use reasonable endeavours to resume normal service as soon as practicable.

Where you access the Services through our iOS application:

15.1 Your use is also subject to Apple's App Store Terms of Service.

15.2 Apple Inc. is not a party to these Terms and has no responsibility for the Services or their content.

15.3 Apple has no obligation to provide any maintenance or support for the application.

15.4 In the event of any failure of the application to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the application.

15.5 Apple is not responsible for addressing any claims relating to the application or your possession or use of the application.

You may close your account at any time through your account settings. We may suspend or terminate your access at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately. Data deletion requests will be processed within 30 days in accordance with our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall first be subject to good-faith negotiation between the parties.

If a dispute cannot be resolved through negotiation within 30 days, it shall be referred to binding arbitration under the rules of the London Court of International Arbitration (LCIA), conducted in English in London, United Kingdom.

Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrAIde with respect to the Services and supersede all prior agreements, understandings, and representations.

We may update these Terms from time to time. Material changes will be communicated via the website or mobile application. Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms. The effective date at the top of this document reflects the most recent version.
